Refinance without filing taxes yet? A current P&L does the job.

On extension, ten months into a great year, or running a brand-new entity, there's no fresh return for a bank to read. A current-period P&L fills that gap, and here's exactly how the refinance works.

Short answer

Yes, you can refinance without filing taxes for the current year. Cap Rate Funding's P&L Only loan uses one current-period profit & loss statement as the entire income file, with no tax returns and no bank statements. It needs 640+ credit and a $150,000 minimum loan, and cash-out or rate-and-term refinances go up to 75% LTV at 660+ credit (70% at 640–659).

Your return is on extension. Or you filed in April, and the business has doubled since. Or your new LLC hasn't finished its first tax year. Either way, this year is the strong one, and you want to refinance: pull cash out, consolidate, or just get a better loan. The bank asks for a return that doesn't exist yet, or one that describes a year you've already outgrown. If you need to refinance without filing taxes for the current year, the fix isn't waiting. It's using a different document.

Why a missing tax return stalls a normal refinance

A conventional refinance qualifies self-employed income from filed tax returns, so when the newest return isn't filed, the lender either waits or falls back on older years. Neither helps you if this year is the strong one.

Here is where the timing goes wrong:

  • On extension. You have until October to file, but the lender wants the return now. Until it's filed, the file is stuck or underwritten on the year before.
  • Mid-year growth. Your last filed return shows where the business was. Ten months of better numbers don't count until next spring.
  • A new entity. You switched from sole proprietor to an LLC or S-corp, or opened a new company. There's no full tax year behind it yet.
  • Write-offs on the return you did file. Even when a return exists, deductions and depreciation shrink the income a bank can count. (Our post on being denied a cash-out refinance as self-employed covers that problem in depth.)

None of that is about your equity or your credit. It's a paperwork calendar problem, and there's a program built for it.

How the P&L Only loan refinances without a filed return

Cap Rate Funding's P&L Only loan uses one profit & loss statement as the entire income file, so no tax return is required because none is requested. No tax returns, no bank statements, no W-2s or pay stubs. A current-period P&L covers exactly the gap a missing return leaves.

Cap Rate Funding, a non-QM direct lender and broker in Irvine, CA, funds this program in-house and also prices it across 100+ wholesale lenders. Every file is priced both ways, and you're told which route it closes on before you commit.

Cash-out refinance on a tax extension: what you can access

On a cash-out refinance, you can access up to 75% of the home's value at 660+ credit, or 70% at 640–659, minus what you owe. The math is the same whether your return is on extension, filed late, or a year away.

Mid-year, extension or new entity: which situation are you in?

All three are handled by the same program; what changes is which P&L tells your story best.

On extension
Your prior year isn't filed yet. A current-period P&L documents the income now, so the refinance doesn't wait on the IRS calendar.
Mid-year, strong year
Your last return is filed but stale. A current-period P&L shows this year's numbers instead of last year's.
New entity
Your business changed structure or is new. A P&L covers the period it has operated. On some programs, a future income projection can qualify the loan on where the business is going, not just where it's been.

Which period the P&L should cover, and whether a CPA-prepared, self-prepared or projection version fits, is set by the program your file is placed with. We confirm that on a call before your CPA prepares anything, and if your CPA needs guidance on the format lenders expect, we provide it.

Keep your first mortgage: second-lien options

If your current first mortgage has a rate worth keeping, you don't have to refinance it at all. A cash-out refinance replaces the whole loan. A second lien borrows against your equity and leaves the first mortgage exactly where it is.

  • P&L-documented HELOC (680+ credit). The same P&L can document a home equity line in second position. Line size and combined LTV are confirmed on a call.
  • Stated-income HELOC (680+ credit, $150,000+ lines). No income documentation of any kind, not even a P&L. It's refinance-only, qualifies on credit and equity, and availability is confirmed by state on a call.
  • Business bank statement second lien (660+ credit). If your deposits tell a stronger story than a P&L, a bank statement loan can sit behind your existing first mortgage. In first position it starts at 620 credit with refinances up to 80% LTV. See the no-income-verification mortgage guide for how the three lanes compare.

What you'll actually need to provide

For a P&L Only refinance, the core file is short: the profit & loss statement, your ID and your current mortgage statement. No tax returns or bank statements of any kind.

  1. Your home value, mortgage balance and a credit range for the 60-second options check (no hard pull).
  2. A quick call to confirm the program, the P&L period and your state.
  3. Your CPA prepares the P&L to that spec (we'll send format guidance if they want it).
  4. Appraisal, underwriting and closing. The hard credit pull happens only once you choose to apply.

If the property is a rental rather than your home, you may not need a P&L at all: a DSCR cash-out refinance qualifies on the property's rent with no personal income documents.

Who this is not for

Better to say it now:

  • Thin equity. P&L refinances stop at 75% LTV (70% at 640–659). If you owe close to that already, there's little to pull out.
  • Credit under 640 or a loan under $150,000. P&L Only isn't available there. A bank statement loan (620+ first position) or the standard 5-Day HELOC ($50,000+, 620+ credit) may fit instead.
  • A primary home outside our footprint. Owner-occupied lending is available only in AL, AZ, CA, CO, FL, ID, IA, LA, MD, MI, MN, NM, NV, OH, OK, OR, PA, TN, TX, UT and WA (see where we lend).
  • Texas homesteads expecting more. Texas caps home-equity borrowing at 80% combined LTV and requires a 12-day waiting period by state law.
  • Anyone whose filed returns already support the loan. If your returns qualify you easily, a conventional refinance usually costs less than non-QM. Use the P&L path when the calendar or the write-offs are the problem.

Common questions

Can I get a cash-out refinance while my taxes are on extension?

Yes. A P&L Only loan qualifies you on a current-period profit & loss statement instead of a filed return, so an extension doesn't hold up the file. Cash-out is available up to 75% LTV at 660+ credit or 70% at 640–659, on loans from $150,000.

Do I need last year's tax return for a P&L loan?

No. Cap Rate Funding's P&L Only loan doesn't request tax returns at all, so no filed return is required. The income file is one profit & loss statement, CPA-prepared (unaudited is fine), with self-prepared and future-income-projection options on some programs.

What period should the P&L cover if I'm mid-year?

That is set by the program your file is placed with, so we confirm it on a call before your CPA prepares anything. If your CPA needs guidance on the format lenders expect, we provide it.

Can I keep my current first mortgage and still use a P&L?

Yes. A P&L can document a second-position HELOC at 680+ credit, which leaves your existing first mortgage and its rate untouched. Line size and combined LTV for that structure are confirmed on a call. With 680+ credit and a line of $150,000 or more, the stated-income HELOC is another second-lien option that needs no income documents at all.

Is a P&L loan only for self-employed borrowers?

No. Anyone who can provide a profit & loss statement can qualify, including 1099 earners and people with side businesses. Self-employed owners are simply the most common fit.

Will checking my options affect my credit?

No. Seeing your options uses no hard credit pull. A hard inquiry happens only later, with your permission, if you decide to apply.
